Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the SafeStep website (safesteptech.com), the SafeStep mobile app and the SafeStep web dashboard (together, the "Service"), operated by DIO Solutions LLC, a Wyoming limited liability company ("DIO", "we", "us"). By using the Service, you agree to these Terms and to our Privacy Policy.

If your company (a "Customer") has signed a separate agreement with DIO, such as a pilot agreement or order form, that agreement governs the Customer's use of the Service and controls if it conflicts with these Terms.

2. Who may use SafeStep

  • You must be at least 18 years old.
  • In the app and dashboard, you must be authorized by a Customer, usually your employer or the company you work for, which creates your account.
  • If you accept these Terms for a company, you confirm that you have authority to bind that company.

3. Your account and signatures

  • Keep your phone and sign-in codes secure. You are responsible for activity on your account.
  • Sign only for yourself. Never sign a record for another person, and never let someone else sign as you. Each signature records the time, the device and the location.
  • Tell your supervisor or us right away if your phone is lost or you think someone else used your account, so the device can be revoked.

Text messages. If you give us your mobile number and agree to receive texts, SafeStep (DIO Solutions LLC) may send you one-time sign-in codes and messages about your demo or pilot request. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out, HELP for help. Carriers are not liable for delayed or undelivered messages. Full details: safesteptech.com/sms.

4. SafeStep is a safety tool, not a safety program

SafeStep supports your safety work. It does not replace your company's safety program, site procedures, training, supervision, permits, or your right and duty to stop work when something is unsafe.

In an emergency, call 911 and follow your site's emergency plan. Do not rely on the app to call for help.

  • Copilot answers can be incomplete or wrong. The Copilot suggests hazards and answers questions from your company's documents, and it can make mistakes. Check every suggestion against your procedures and ask your supervisor when in doubt. A person must accept or dismiss every suggestion.
  • Without signal, alerts wait. Records you complete without signal are saved on your phone and sent when it reconnects. Notifications, Stop Work alerts and deliveries may be delayed until then.
  • Your company is responsible for its safety decisions and for meeting its legal obligations, including OSHA and operator requirements. Using SafeStep does not by itself make a site, task or company compliant.

5. Acceptable use

You agree not to:

  • Enter false information, backdate records or sign for someone else.
  • Try to change, delete or tamper with submitted records, or get around the Service's security.
  • Access another company's data, or anyone's account, without permission.
  • Copy, reverse engineer or resell the Service, or use it to build a competing product.
  • Upload malware or content that is illegal, or that you have no right to share.
  • Use the Service in a way that breaks the law or harms others.

6. Customer content and records

  • Records, forms, procedures, photos and other content entered for a Customer ("Customer Content") belong to that Customer.
  • The Customer gives DIO permission to store, process and transmit Customer Content only as needed to provide, secure and support the Service, as described in the Privacy Policy. We do not use Customer Content to train AI models.
  • Submitted records are sealed and cannot be edited. A correction creates a new version, and the original stays on file.
  • Records are kept for the retention period described in the Privacy Policy or the Customer's agreement. A Customer can export its records at any time.

7. Demo and pilot use

The demo on our website and any demo version of the app use fictional data. Do not enter real worker, company or job information into a demo. Paid pilots run under a separate pilot agreement.

8. Our property

The Service, including its software, design, text, templates and the SafeStep name and logo, belongs to DIO or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service while your account is active. If you send us feedback, we may use it without any obligation to you.

9. Fees

Fees for Customers are set in the Customer's agreement or order form. Individual workers do not pay to use SafeStep through their company.

10. Third-party services

The Service relies on third-party providers, such as hosting, text messaging, email and AI providers, and app stores. Their services are covered by their own terms, and we are not responsible for outages or acts outside our reasonable control.

11. App stores

If you download the app from the Apple App Store or Google Play, these Terms are between you and DIO, not Apple or Google. Apple and Google are not responsible for the app, its content, maintenance, support or any claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You also agree to the usage rules of the store you downloaded from.

12. Suspension and termination

Your company can remove your access at any time. We may suspend or end access if you break these Terms, if needed to protect the Service or others, or when the Customer's agreement ends. Sections that by their nature should continue (including 6, 8 and 13 through 16) survive termination.

13. Disclaimers

Except as stated in a Customer's written agreement, the Service is provided "as is" and "as available." To the fullest extent permitted by law, DIO disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted or error-free, or that Copilot answers will be accurate or complete.

14. Limitation of liability

To the fullest extent permitted by law, DIO will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. DIO's total liability for any claim relating to the Service will not exceed the greater of the amount paid to DIO for the Service in the 12 months before the claim, or one hundred U.S. dollars ($100). Some places do not allow these limits, so they may not apply to you.

15. Indemnity

If you or your company use the Service in breach of these Terms or the law, you agree to cover DIO's reasonable costs, including legal fees, arising from claims by others caused by that use.

16. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Wyoming, and you and DIO agree to their jurisdiction, unless a Customer's agreement says otherwise.

17. Changes to these Terms

We may update these Terms as the Service changes. We will post the new version here with a new "Last updated" date, and tell Customers about material changes before they take effect. Continuing to use the Service after that means you accept the updated Terms.
